1. Ownership of Site Content

All content on this website — including but not limited to text, graphics, logos, button icons, images, artwork, product photographs, page layouts, design elements, data compilations, software, and our brand name, slogan and trade dress “Keep Memories Vivid” — is the property of KeepItVivid or its content suppliers, and is protected by applicable copyright, trademark and other intellectual property laws of the United States, the United Kingdom and other countries.

2. Limited License

We grant you a limited, revocable, non-exclusive and non-transferable licence to view and make personal, non-commercial use of this website. This licence does not include any right to reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of this website for commercial purposes without our prior written consent. Any unauthorized use terminates the permission granted by us.

3. Trademarks

The KeepItVivid name, the “Keep Memories Vivid” slogan, and all related logos, product names and design marks are our trademarks or registered trademarks. They may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion, or in any manner that disparages or discredits us. All other trademarks not owned by us that appear on this website are the property of their respective owners.

4. Customer-Submitted Content

By uploading images, photographs, text or other content to personalize a product, you confirm that you own the content or otherwise have the right to use it. You retain ownership of your content; you grant us the limited licence described in our Terms of Service solely to produce, deliver and provide support for your order. You agree not to upload content that infringes the intellectual property, privacy or other rights of any third party. We reserve the right to refuse or cancel any order that we reasonably believe infringes the rights of others.

5. Reporting Intellectual Property Infringement

If you believe that content on this website infringes your intellectual property rights, please contact us by email and include the following information:

  1. Identification of the right you claim has been infringed;
  2. The specific location (URL) on this website of the material you believe is infringing, with enough detail for us to locate it;
  3. Your full name, mailing address, telephone number and email address;
  4. A statement that you have a good-faith belief that the use complained of is not authorized by the rights holder, its agent or the law;
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorized to act on the rights holder’s behalf;

We will review all valid notices and will remove or disable access to infringing material where appropriate. We may also terminate the accounts of users who repeatedly infringe the intellectual property rights of others.
