Keep Memories Vivid

Welcome to KeepItVivid. These Terms of Service (“Terms”) govern your access to and use of the KeepItVivid website (the “Site”) and your purchase of personalized gifts, apparel, blankets, drinkware and other keepsakes (“Products”) from us. By accessing the Site, placing an order, or uploading any content, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By placing an order, you represent that all information you provide is accurate and complete.

2. Products & Custom Orders

  • Our Products are made to order — each item is created individually based on your selected design, size and personalization.
  • Because every order is customized, colors and appearance may vary slightly from what you see on your screen due to monitor settings, material characteristics and printing methods. Minor variations of this kind do not constitute defects.
  • We may update, discontinue, or change our product catalog at any time without notice.

3. User Content & License

3.1 What you upload. When you upload images, photos, text or other content (“User Content”) to personalize a Product, you must either own it or have the right to use it.

3.2 License grant. By uploading User Content, you grant KeepItVivid a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify (including cropping, resizing and color adjustment) and print your User Content, solely for the purpose of producing and delivering your order and for related quality and customer-service purposes.

3.3 Your warranties. You represent and warrant that your User Content does not infringe the rights of any third party, does not violate any law, and is not defamatory, obscene, or otherwise objectionable.

3.4 Refusal. We reserve the right to refuse or cancel any order that we reasonably believe violates these Terms or applicable law.

4. Orders, Pricing & Payment

  • All prices are stated in US Dollars (USD) unless otherwise indicated.
  • We currently accept payment through PayPal. By completing a purchase you also agree to the payment processor’s terms.
  • We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or stock unavailability.

5. Shipping & Delivery

  • Orders are generally delivered within 10–20 days depending on your location.
  • International shipments may be handled by third-party logistics providers, and final-mile delivery in the United States may be provided by USPS, UPS or FedEx.
  • Delivery timeframes are estimates, not guarantees. Delays caused by carriers, customs clearance, or other events outside our reasonable control are not our responsibility.
  • Where tracking is available, tracking information is shared with you via your order status and email notifications.

6. Returns & Refunds

Please review our Refund Policy for full details. Generally, order issues (returns, refunds and quality concerns) are handled within 1–3 business days of being reported. Because Personalized Products are made to order, they may not be eligible for return unless defective, as described in our Refund Policy.

7. Intellectual Property

All content on the Site — including text, graphics, logos, designs and our slogan “Keep Memories Vivid” — is our property or the property of our licensors, and is protected by applicable intellectual property laws. You may not use our branding without our prior written consent.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and our Products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or any order shall not exceed the amount you actually paid for the relevant order. We shall not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits or lost data.

10. Indemnification

You agree to indemnify and hold KeepItVivid and our team harmless from and against any claims, damages, liabilities and expenses arising out of your User Content, your use of the Site, or your breach of these Terms.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

12. Third-Party Services

Payments are processed by third-party providers (currently PayPal). We are not responsible for the acts or omissions of third-party services. The Site may contain links to third-party websites; we are not responsible for their content or practices.

13. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which KeepItVivid operates, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved in the competent courts of that jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
